Ohio’s Rape Statute: What the Law Requires

Under Ohio Revised Code 2907.02, rape occurs when a person engages in sexual conduct with another person under specific circumstances: by force or threat of force; by administering a drug, intoxicant, or controlled substance to impair the other person’s judgment or control; when the other person is under 13 years of age, regardless of whether the accused knew the victim’s age; or when the other person’s ability to resist or consent is substantially impaired by a mental or physical condition or advanced age.

Rape is classified as a first-degree felony and can carry a potential life sentence. Under certain aggravating circumstances, including causing serious physical harm to the victim or when the victim is under age ten, Ohio law permits a court to impose a sentence of life without parole. Ohio’s age of consent is 16, and sexual conduct with a person younger than 13 is treated as rape as a matter of law, without regard to the accused’s knowledge of the victim’s age.

Because the statute defines each required element precisely, demonstrating that the alleged conduct doesn’t satisfy one or more of those elements can be a meaningful part of the defense and may support a reduction to a lesser charge such as sexual battery or a dismissal.

Ohio ESORN Registration Tiers

A rape conviction triggers registration obligations under Ohio’s Electronic Sex Offender Registration and Notification system, known as eSORN. These obligations exist separately from, and in addition to, any criminal sentence.

Ohio places convicted sex offenders into one of three tiers based on the offense:

• Tier 1: Registration every 12 months for 15 years
• Tier 2: Registration every 180 days for 25 years, listed publicly
• Tier 3: Registration every 90 days for life, listed publicly

Registered offenders must report home, work, and school addresses to the local sheriff’s office within three days of moving into a county. Under Ohio law, registered sex offenders are generally prohibited from establishing a residence within 1,000 feet of a school.

Statute of Limitations & DNA Match Exceptions

Under Ohio Revised Code 2901.13, prosecution of a rape charge is generally barred unless commenced within 25 years of the offense. If a DNA record matches an identifiable person within that window, prosecution may begin within the longer of 25 years from the offense or 5 years from the DNA match. If the match occurs after the 25-year period has passed, prosecution may still begin within 5 years of that match. Cases from decades ago can be revived when forensic evidence produces a new identification.
