How Ohio Defines Prescription Fraud Offenses
Prescription fraud is a general description, not the name of a single Ohio offense. The applicable charge depends on what the state alleges happened. Ohio Revised Code 2925.22 addresses deception to obtain a dangerous drug, while Ohio Revised Code 2925.23 addresses illegal processing of drug documents.
These statutes cover distinct forms of alleged conduct:
- Obtaining drugs through deception: Ohio Revised Code 2925.22 prohibits using deception to obtain the administration, prescription, or dispensing of a dangerous drug, the statutory term for drugs subject to specified legal controls.
- Possessing prescription blanks: The same statute covers possession of an uncompleted preprinted prescription blank used to write a prescription.
- Creating or using false drug documents: Ohio Revised Code 2925.23 covers knowingly making a false statement in a prescription, order, report, or record. It also applies to forged prescriptions, false drug labels, prescription blanks, official written orders, and prescriptions or official orders obtained by theft.
What the State Must Prove
Labels such as doctor-shopping or forged prescription don’t establish every element of an offense. A deception-to-obtain charge requires evidence that a dangerous drug, prescription, or dispensing was procured through deception. A false-statement or forged-document charge requires proof that the accused acted knowingly rather than through accident or mistake.
We develop an individualized case strategy by examining prescription records, communications, document handling, witness accounts, and evidence offered to establish knowledge or deception. Our recent case wins include a dismissed narcotics charge and a dismissed check fraud case. Those matters don’t predict another case’s result, but they reflect our experience challenging drug-related and fraud allegations.
